Terms of service.

Last updated April 2026. By using Hiyer, you agree to these terms.

1. The service

Hiyer is a software product that helps organizations measure workforce sentiment using the CQI+ survey methodology. It is operated by UpDoc, Inc. ("UpDoc," "we," "us"). "You" refers to the organization that has subscribed to Hiyer and to the individuals acting on that organization's behalf.

2. Your account

To use Hiyer you need an account, which you create by completing a Stripe checkout. You are responsible for keeping your sign-in credentials (magic link access) secure. If you suspect unauthorized access, email ben@updocmedia.com immediately.

You may add teammates to your organization as admins or viewers using signed invite links. You are responsible for the actions of users you grant access to.

3. Subscriptions and billing

Hiyer is sold on monthly or annual subscription terms. The pricing page details the current plans. Subscriptions renew automatically at the end of each billing period unless cancelled. You can cancel at any time from the Stripe customer portal; access continues through the end of the paid period. No refunds for partial periods.

We reserve the right to change prices. If we do, we will provide at least 30 days' notice before changes take effect for existing subscribers.

Every plan includes a 7-day free trial. You are not charged until day 8 of the first billing period.

4. Your data, your property

You own the aggregate survey data your organization generates using Hiyer. UpDoc uses it to (a) provide the service to you, (b) compute and improve industry benchmarks (fully aggregated, never identifiable), and (c) nothing else.

UpDoc does not sell customer data, does not market to your team members, and does not use your data to train models.

On cancellation you may request an export of your org's aggregate data; we provide it within 14 days. Per our Privacy Policy, anonymized contributions to our industry benchmarks persist beyond cancellation. They cannot be traced back to any individual or organization.

5. Acceptable use

You agree not to:

  • Attempt to identify anonymous survey respondents, circumvent the suppression rules, or correlate timestamps to individual activity.
  • Use Hiyer to survey populations outside your organization without an Index Access subscription.
  • Reverse engineer, scrape, or attempt to extract the CQI+ item bank for redistribution.
  • Upload material that violates law, infringes intellectual property, or contains malicious code.
  • Use Hiyer's public API (when available) in ways that breach the published rate limits or abuse patterns that harm service for other customers.

If we determine that your use violates these rules, we may suspend or terminate your account. We will notify you in writing and, where reasonable, give you time to cure.

6. Respondent anonymity

Hiyer is built around the commitment that individual survey responses cannot be linked to the person who submitted them. You agree not to attempt to defeat this commitment, including by:

  • Issuing single-use PINs to groups of fewer than five people and treating the resulting cohort as identifying.
  • Using timestamp or cohort-membership information to infer authorship.
  • Pressuring team members to disclose their responses.

Violations may result in immediate suspension and disclosure to the affected respondents' counsel on request.

7. Service level

UpDoc targets 99.5% uptime for Hiyer's web application and public survey pages. This is a target, not a warranty. We do not currently offer SLA credits.

8. Intellectual property

The Hiyer application, the CQI+ item bank, the Corporate Quality Index methodology, and the industry benchmark dataset are UpDoc's intellectual property. Your subscription grants you a non-exclusive, non-transferable license to use them for the purpose of running Hiyer inside your organization.

You retain ownership of your organization's name, branding, and any content you upload. You grant UpDoc a limited license to display this content inside your dashboard for the purpose of providing the service.

9. Disclaimers

Hiyer is provided "as is." The CQI+ measures workforce sentiment; it does not predict individual behavior, is not a clinical assessment, and should not be used as the sole basis for employment decisions about a specific person (which would be impossible anyway given the anonymity architecture).

To the maximum extent permitted by law, UpDoc disclaims all warranties, express or implied, including warranties of merchantability, fitness for a particular purpose, and non-infringement.

10. Limitation of liability

To the maximum extent permitted by law, UpDoc's total aggregate liability for any claims arising from your use of Hiyer will not exceed the greater of (a) the fees you paid to UpDoc in the twelve months immediately preceding the claim or (b) $1,000.

UpDoc is not liable for indirect, consequential, special, or punitive damages, including lost revenue, lost opportunity, or loss of goodwill, even if we were advised of the possibility of such damages.

11. Governing law

These terms are governed by the laws of the State of Delaware, without regard to conflict-of-law principles. Any dispute arising out of these terms will be resolved in the state or federal courts located in New Castle County, Delaware.

12. Changes to these terms

We may update these terms from time to time. If we make material changes, we will give you at least 30 days' notice by email. Continued use of Hiyer after the effective date constitutes acceptance.
